Partner Visa (Subclass 309/100)

The Partner Visa (Subclass 309/100) is designed for the spouses or de facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens to live in Australia. This visa allows partners to stay in Australia temporarily (Subclass 309) and, if certain conditions are met, to apply for permanent residency (Subclass 100). The Subclass 309 visa is the provisional visa, while the Subclass 100 visa is the permanent visa.

Visa Stages

  • Temporary Partner Visa (Subclass 309): This is the first stage, allowing the applicant to enter and stay in Australia temporarily while their permanent Partner Visa (Subclass 100) is processed.
  • Permanent Partner Visa (Subclass 100): This is the second stage and can be granted if the relationship is ongoing and genuine, and all other criteria are met.

Eligibility Criteria

  • Sponsorship: Be sponsored by an eligible partner who is an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • Relationship: Be in a genuine and ongoing relationship with your partner.
  • Age: Both the applicant and the sponsor must be at least 18 years old.
